Copyright & DMCA

Draft prepared for attorney review. A DMCA safe-harbour position requires a registered designated agent with the U.S. Copyright Office. That registration must be completed, and the details below filled in, before launch.

Our position

Card names, artwork and imagery belong to their respective rights holders and are used descriptively to identify cards being traded. User-uploaded photographs belong to the users who took them.

Reporting infringement

Send a written notice to our designated agent at [DMCA AGENT ADDRESS] including:

  1. A physical or electronic signature of the copyright owner or authorised agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material claimed to be infringing, with enough detail to locate it — a direct URL is best
  4. Your contact details: address, telephone number and email
  5. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on their behalf

Counter-notification

If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address including:

  1. Your physical or electronic signature
  2. Identification of the removed material and where it appeared
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your name, address and telephone number, and consent to the jurisdiction of the federal court for your district (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the complaining party

Repeat infringers

We terminate the accounts of repeat infringers in appropriate circumstances.

Misrepresentation

Knowingly materially misrepresenting that material is infringing, or was removed by mistake, carries liability for damages under 17 U.S.C. §512(f).
